- Cannabinoid Licensing and Tax Act. Retailers selling cannabinoid products in Utah are licensed by the State Tax Commission. A 10% retail tax applies to these products at point of sale.
What stays the same as federal hemp law:
- ≤0.3% Δ9-THC by dry weight (federal baseline; Utah is stricter via total-THC).
- Hemp-derived CBD without psychoactive THC content is broadly available.
What's not legal under Utah's general hemp framework:

How Utah's framework holds up under federal changes
Utah's hemp framework is stricter than the federal baseline on per-serving math (Utah caps any consumer hemp product at 5 mg THC per serving) but allows packages of up to 150 mg total THC — far over the upcoming federal §781 ceiling of 0.4 mg total THC per container. The result: Utah's framework survives §781 in spirit (Utah will keep regulating hemp under its own Cannabinoid Licensing and Tax Act) but the specific products on Utah shelves will narrow significantly as the state framework reconciles with the new federal floor.
Utah's Cannabinoid Licensing and Tax Act operates as its own regulatory regime — total-THC measurement, per-serving caps, retailer licensing, 21+ verification. Those state-level requirements stay in place regardless of what federal law does. But Utah cannot authorize sales that violate federal hemp law, so when §781 redefines federal hemp at 0.4 mg total THC per container, Utah's general retail market has to narrow to match.
What this means in practice: Utah-compliant products that meet the 5 mg/serving rule but exceed 0.4 mg total per package (essentially every multi-dose gummy product) move from general retail into Utah's medical cannabis dispensary system. Topical hemp products (the Muscle + Joint Salve) are unaffected because topical products typically formulate well under the §781 cap and topical application does not produce drug-test positives.

Section 781 of P.L. 119-37 caps total THC at 0.4 mg per consumer-facing container — far stricter than Utah's 150 mg per-package rule.
