Is hemp Δ9 legal in Colorado?
As of Oct 2026, under SB 23-271 (C.R.S. 44-10-209), hemp products with more than 1.75 mg THC per serving, or a CBD:THC ratio below 15:1, are intoxicating hemp products. They may only be sold through Colorado's licensed marijuana system. Federal note: from December 11, 2026, P.L. 119-37 §781 (delayed by P.L. 119-103) limits hemp products to 0.4 mg total THC per container.
