Hemp CBD Legal Status in Georgia
Hemp-derived CBD is legal in Georgia under O.C.G.A. § 2-23-1 et seq., Georgia's Hemp Farming Act, which aligns with the 2018 Farm Bill. Products must contain ≤0.3% Δ9-THC and be derived from licensed hemp. Georgia consumers can purchase hemp CBD products freely at retail stores and online.
Low-THC Oil vs. Hemp CBD
Georgia's original 2015 law (Haleigh's Hope Act) allowed patients with qualifying conditions to access cannabis oil with ≤5% THC — this is a separate medical program from hemp CBD. Hemp CBD products (≤0.3% THC) do not require any medical authorization and are available to any adult.
