Despite its progressive cannabis reputation, California has taken a cautious approach to hemp-derived CBD, particularly in food and beverages. Assembly Bill 45 (2021) created a clearer framework for hemp products, but significant restrictions remain.
What's Legal in California
As of 2026, the following hemp CBD products are legal to sell in California to adults 21+:
- CBD tinctures and oils (dietary supplements)
- CBD topicals and cosmetics
- CBD capsules and tablets
- Hemp flower (for personal use)
AB 45 legalized industrial hemp extracts in California with a total THC limit of 0.3% and a maximum of 0.5 mg of THC per serving for dietary supplements.
CBD in California Food and Beverages
This is where California gets complicated. The California Department of Public Health (CDPH) restricts the sale of CBD-infused food and beverages unless produced under a separate hemp food manufacturer license. Many "CBD drinks" at cafes and restaurants are technically non-compliant, but enforcement has been limited.
Age Requirement: 21+
AB 45 set the minimum age for hemp CBD product purchases at 21 — aligning hemp with recreational cannabis. This is higher than most other states. Retailers are required to verify age, and products must not be marketed toward minors.
Delta-8 and Synthetic Cannabinoids
California has banned the sale of delta-8 THC and other synthetically derived cannabinoids outside of the licensed cannabis retail system. Only naturally occurring hemp cannabinoids present in the original hemp plant are permitted in hemp products.
