Hemp Δ9 Law Changing November 12, 2026 — What Happens to Your CBD

The federal definition of "hemp" is changing on November 12, 2026. Under Public Law 119-37 Section 781 — already passed by Congress and signed into law — the 2018 Farm Bill's "≤0.3% Δ9 THC by dry weight" hemp standard is being replaced with a new standard:

No more than 0.4 milligrams of total THC per container for any hemp product intended for human or animal use through ingestion, inhalation, or topical use.

This is a fundamental redefinition. Most hemp-derived Δ9 THC products currently sold nationwide — including ours, including most of our competitors' — contain far more than 0.4mg of total THC per container. As of November 12, 2026, those products will no longer be federally compliant as "hemp."

What's actually changing (the technical version)

The 2018 Farm Bill defined hemp as cannabis containing ≤0.3% Δ9 THC by dry weight. This was the gateway that legalized:

• Hemp-derived CBD products
• Hemp-derived Δ9 THC gummies (a single gummy could contain 5–10mg of Δ9 as long as the total product weight kept the percentage low)
• Hemp-derived Δ8, Δ10, and other isomers
• Hemp tinctures, softgels, salves, and topicals

The new federal standard under Public Law 119-37, Section 781 changes two things:

1. From percentage to absolute amount. The 0.3% by dry weight test let candy-shaped gummies pack significant THC because the gummy was heavy. The new 0.4mg per container cap doesn't care about product weight — it caps total THC per package, period.
2. From Δ9 only to total THC. The new rule sums up Δ9 THC, Δ8 THC, THCA (the precursor that converts to THC when heated, calculated at the standard 0.877 conversion factor), and other THC isomers. Total THC, not just one form.

For context on how restrictive 0.4mg per container is:

• A single 5mg hemp Δ9 gummy = 12.5× the per-container limit by itself
• A 10-pack of 5mg gummies = 50mg total THC = 125× the per-container limit
• A 1oz tincture with full-spectrum hemp extract at typical concentrations = well over 0.4mg total THC

The end result: virtually every functional hemp Δ9 product currently on the market becomes non-compliant. Same for full-spectrum CBD tinctures, softgels, and gummies (which contain trace Δ9 from the full-spectrum extract). Same for many CBN products. Same for most Δ8 products.

Why this is happening

Three forces drove the change:

1. Congressional intent. The 2018 Farm Bill was written for industrial hemp (fiber, seed, raw flower). Congress didn't anticipate that the language would also legalize candy-shaped Δ9 edibles. Section 781 is a closing of that loophole — bringing the law back in line with what Congress originally intended.
2. State regulatory pressure. California (AB 8, effective January 2026), Florida (effective November 13, 2026), Texas (March 2026 DSHS rule), and others have all tightened hemp Δ9 rules in 2025-2026. Federal action consolidates and harmonizes those rules.
3. The licensed cannabis industry's lobbying. Cannabis dispensaries in states like California, Colorado, and Michigan have been losing business to hemp Δ9 products sold at lower prices through general retail. They lobbied aggressively for federal closure of the "hemp loophole."

The federal change was telegraphed in legislative drafts since 2023 and became law through Public Law 119-37. The November 12, 2026 implementation date is the 6-month transition window Congress built in. It's not a surprise — it's just final.

What this means for you as a customer

Depending on what you use and where you live, your situation looks different. The honest breakdown:

If you use Δ9 gummies for sleep, stress, or recovery

After November 12, 2026, the Δ9 gummies you currently buy from us (or anyone else) will not be federally compliant as "hemp." Three paths forward:

• Stock up between now and November 11. Existing inventory in your home is yours to use; the restriction is on retail sale, not possession.
• Switch to topical products (our Muscle + Joint Salve likely remains compliant — see "topicals" section below)

If you use full-spectrum CBD tinctures or softgels

Same situation. Our Sleep, Stress, and Muscle + Joint tinctures all use full-spectrum hemp extract that contains trace Δ9. After November 12, those formulations will be over the 0.4mg per container cap.

If you use the salve / topical products

Topicals are the most defensible category under the new law. The 0.4mg per container cap applies to products "intended for human or animal use through ingestion, inhalation, or topical use" — topicals are covered, but the regulatory interpretation of "topical use" for products that don't deliver THC systemically is less clear. Most legal analysts expect topicals to face some pressure but to survive in a more clearly-regulated form. You have an alternative: California-style dispensaries sell Δ9 THC products through state cannabis programs. Higher taxes, age 21+ restrictions, different products — but legal channels remain. The hemp Δ9 D2C model ends; the licensed cannabis channel continues.

The 0.4mg per container cap technically includes topical products. However, the regulatory interpretation of "topical use" for products that don't deliver THC systemically is less clear. What about delta 8, HHC, and other minor cannabinoids?

Will the law be challenged in court?

Possibly. Hemp industry associations have begun preparing legal strategies. Pre-emption arguments (state laws conflicting with federal), commerce clause challenges, and procedural challenges to the specific language of Section 781 are all on the table. Court action could delay implementation, but the underlying legal direction is unlikely to fully reverse.

Should I be stocking up?

Can I get this through a cannabis dispensary?

In states with legal cannabis programs (CA, CO, MI, WA, OR, NV, NY, NJ, MA, IL, AZ, MD, MO, MT, ME, RI, CT, VT, DE, MN, OH, plus medical-only states), licensed cannabis dispensaries sell Δ9 THC products with different (often higher) cannabinoid content than hemp Δ9.
