Under the statute, products exceeding 0.4 milligrams of total THC per container — or containing Δ8, Δ10, THCA, or synthesized cannabinoids — are classified as cannabis, not hemp, and at brick-and-mortar retail can only be sold through licensed Class 5 Cannabis Retailers.

What New Jersey law allows (as of May 2026)
Adult-use cannabis (licensed retailers, 21+)
New Jersey has legal adult-use cannabis. Class 5 Cannabis Retailers can sell hemp-derived cannabinoid products that meet labeling and testing rules, plus regular cannabis products.
