SB 56 specifically restricts Δ8, Δ10, and THCA products that convert to Δ9 outside dispensaries.
THC-infused beverages outside dispensaries
SB 56 notably did NOT carve out an exception for hemp THC beverages — they're restricted in general retail too.
Ohio hemp law — how we got here
2018: Federal Farm Bill legalizes hemp (≤0.3% Δ9 by dry weight).
2019: Ohio implements the federal hemp framework. CBD and hemp Δ9 enter the Ohio retail market.
November 2023: Ohio voters pass adult-use cannabis legalization (Issue 2). Licensed dispensaries begin operating.
December 19, 2025: Governor Mike DeWine signs Senate Bill 56.
March 20, 2026: SB 56 takes effect. Intoxicating hemp Δ9 (and Δ8, Δ10, THCA) restricted to licensed dispensaries. 0.4mg total THC per container becomes the general-retail threshold.
November 12, 2026: Federal Public Law 119-37 adopts the same 0.4mg total-THC-per-container standard nationwide. Ohio is already aligned.
