CBD in Tennessee: Hemp Laws, THC Rules and Buying Guide

A plain-English guide to what's legal, what's regulated, and what to look for when buying CBD in Tennessee.

Tennessee has been one of the more straightforward hemp CBD markets in the South: hemp has been legal at the state level since 2014, there's no recreational cannabis program to divert demand to dispensaries, and the online hemp CBD market is well-established. In 2024, Tennessee passed HB 1690, which formalized a licensed-retailer scheme for hemp-derived cannabinoid products with age and serving-size limits. Here's what Tennessee buyers should know in 2026.

Federal frame: the 2018 Farm Bill

Under the 2018 federal Farm Bill (Pub. L. 115-334), "hemp" is defined as cannabis containing 0.3% or less Δ9-THC by dry weight. Hemp and hemp-derived products — including CBD — were removed from the federal Controlled Substances Act and made legal to cultivate, sell, and ship across state lines, subject to state regulation.

Tennessee state law

Tennessee authorized industrial hemp through the Tennessee Hemp Act, codified at T.C.A. § 43-27 et seq., administered by the Tennessee Department of Agriculture. Hemp-derived CBD products meeting the federal ≤0.3% Δ9-THC threshold are legal to sell, buy, and possess in Tennessee.

There is no recreational adult-use cannabis program in Tennessee. Possession of marijuana (cannabis with more than 0.3% Δ9-THC) remains a criminal offense under Tennessee law, with severity scaling by quantity.

In 2024, Tennessee passed House Bill 1690, which created a regulatory framework for "hemp-derived cannabinoid products." Under HB 1690:

  • Hemp-derived cannabinoid products (including Δ8-THC, Δ9-THC at federally compliant levels, THCA, THCP, etc.) may only be sold by licensed retailers.
  • Buyers must be 21 or older.
  • Per-serving cap of 25 milligrams of total THC for edibles; per-package limits also apply.
  • Products must be tested by an ISO/IEC 17025-accredited lab and carry labeling consistent with state rules.

Non-intoxicating hemp CBD (no THC, isolate, or broad-spectrum at trace levels) is broadly available across both licensed and general retail channels.

Practical upshot: hemp CBD with ≤0.3% Δ9-THC is legal in Tennessee online and in retail. Intoxicating hemp products (Δ8, full-spectrum with appreciable THC, edibles) fall under HB 1690's licensed-retailer + 21+ + serving-cap regime.

What you can buy in Tennessee

  • Hemp-derived CBD (isolate, broad-spectrum) — broadly legal, no special permit.
  • Full-spectrum CBD — legal at ≤0.3% Δ9-THC; if it contains appreciable THC, falls under HB 1690's licensed-retailer rules.
  • CBG, CBN, CBC products — legal as hemp extracts at the same THC threshold.
  • Topicals — legal.
  • Δ8-THC and other hemp-derived cannabinoid products — legal under HB 1690 only through licensed retailers, with 21+ verification, serving caps, and lab testing.
  • High-THC marijuana — illegal under Tennessee state law.

Buying CBD online in Tennessee

Tennessee residents can buy hemp-derived CBD online from out-of-state retailers and have it shipped to a Tennessee address under the 2018 Farm Bill's interstate commerce provisions. When buying online, check for:

  1. A current Certificate of Analysis (COA) from an ISO/IEC 17025-accredited lab — confirms Δ9-THC content, full cannabinoid profile, and contaminant testing.
  2. Domestic hemp sourcing with a clear chain of custody. Tennessee, Kentucky, Utah, and Colorado are well-established hemp-producing states.
  3. Compliance with HB 1690 if the product contains any appreciable THC — the seller should be operating as a licensed Tennessee retailer or shipping through a compliant out-of-state channel.

What changed recently in Tennessee

Tennessee was one of the earlier southern states to legalize hemp (2014 pilot, 2016 statewide expansion), and the framework operated for several years without major friction. HB 1690 of 2024 then formalized a licensed-retailer scheme for hemp-derived cannabinoid products with three core constraints: 21+ age verification, 25 mg per serving cap on edibles, and mandatory ISO/IEC 17025-accredited lab testing with labeling consistent with state rules.

Implementation has been steady through 2024 and into 2025, with the Tennessee Department of Agriculture coordinating retailer licensing.
